The council of ministers gets to lead all the ministries. The cabinet minister gets help from officials of specific departments in terms of data and decision making. They assist in developing the policy and getting it implemented as well. At times the cabinet minister does not have a ministry to head, yet he/she will be the minister without a portfolio. The cabinet ministers get called as

  • Junior ministers
  • Ministers of state

 

The cabinet minister ceases to hold the post in the  following circumstances

  • In case of death of the minister
  • Resignation
  • Dismissed by the president for unconstitutional acts
  • Violating the law, dismissal as directed by the judiciary
  • No longer eligible to be the member of the parliament

These cabinet ministers are responsible for the lower house of the state, the House of People (Lok Sabha) because they have been elected by the people to represent them in the parliament. A minister can present a bill to be passed in the Lok sabha, the failure of which gets attributed to the entire council of ministers.

 

If the cabinet ministers of a particular ruling party lose the confidence motion in Lok sabha, they would tender their resignation to the president and facilitate the formation of a new government. A lone minister cannot decide without consulting the cabinet members if there has to be a proclamation of an emergency. The minister has to submit it in writing to the President of India for taking the needful action.

 

According to the constitution, the number of the council of ministers should not exceed 15% of the total number of members that are present in the Lok Sabha. For them to be a cabinet minister, they should be 

  • Members of parliament
  • Of either house(upper or lower)
  • Have to be a member for at least six months

If the above criteria don’t get complied with, the cabinet minister is stripped off his post in immediate effect.

 

The functions or duties of a cabinet minister are

  • The minister has to make decisions concerning national issues and also direct the government policies towards them.
  • Discussing the national problems in the parliament and finding solutions to them
  • The presentation of bills on behalf of the respective government departments
  • The duty of the ministers includes looking into the security of the country, foreign affairs, and the good economic health of the nation.
  • The cabinet ministers will be acting as heads of various administrative departments of which they would have to take care of the day to day progress.
  • The cabinet of ministers has the power to get the law passed in both the houses of the parliament. In the same fashion, they also oppose the bill from getting adopted. In short, they have the power to make laws that will get implemented to the entire country.
  • The cabinet has the final decision in matters of finance by preparing a 
  • budget for the entire financial year
  • to propose taxes
  • the expenditures get made
  • allocation  of resources

Finally, it has to be noted that a majority party elected and chosen by the prime minister can make it to the cabinet berth.
